These Terms govern the use of Postal (postal.so), a service for sending transactional and marketing emails by API, SMTP, and dashboard. By creating an account or using the service, you agree to these Terms and to the Privacy Policy.
1. The service
Postal lets you send emails from domains you control. The service includes:
- transactional sending: domain verification, sending by API and SMTP, templates, receiving emails (inboxes), delivery event logging, webhooks, and the suppression list;
- marketing: audience (contacts, segments, topics, and properties), sign-up forms, campaigns, and automations;
- AI assistant: suggestions for writing, reviewing, and analyzing emails.
The service is in beta: features, limits, and conditions may change, and there is no service level agreement (SLA) at this stage.
2. Your account
- You are responsible for the account information, for keeping your password and API keys secret, and for everything sent with them.
- You may only register domains that you own or are authorized to use.
- Whoever manages a team is responsible for the members they invite and the permissions they grant.
- Notify us immediately through the contact form if you suspect misuse of your account or your keys.
3. Acceptable Use Policy
Postal accepts two kinds of sending, each with its own rules:
- Transactional emails: messages triggered by an action or relationship of the person with your service, such as sign-up confirmation, verification codes, password recovery, receipts, order confirmations, and account notifications. They must not contain promotional content as the main purpose of the message.
- Marketing emails: campaigns, newsletters, and automations with promotional or informational content, sent only through Postal's marketing features and only to contacts who have given consent.
Consent and unsubscribing in marketing
To send marketing emails, you commit to:
- send only to people who have consented freely, with information, and unambiguously to receive your messages, and keep proof of that consent;
- prefer double confirmation (double opt-in) and never use pre-checked consent boxes;
- keep the unsubscribe link and the one-click unsubscribe that Postal includes in every send, without hiding them or making them harder to use;
- honor unsubscribe and preference-change requests immediately, including those made through other channels;
- clearly identify the sender and state, where applicable, how the person joined the list;
- not reactivate unsubscribed or suppressed contacts without new consent.
You may not use Postal to
- send spam or unsolicited messages;
- send to lists that are purchased, rented, automatically scraped, from third parties, or without provable consent;
- send marketing through transactional sending (API or SMTP) to avoid the consent and unsubscribe rules;
- carry out phishing, fraud, sender spoofing, or any attempt to deceive the recipient;
- distribute malware, malicious links, or content that violates the law;
- promote adult content, unauthorized gambling, illegal products, pyramid schemes, or similar schemes;
- send content that infringes third-party rights, including intellectual property and privacy;
- get around sending limits, the suppression list, unsubscribing, or other safeguards of the service.
Violations of this Policy affect the account reputation and may lead to sending being paused, limits being reduced and the account being suspended or closed, as set out in section 7.
Sending quality
- handle bounces and complaints, without trying to resend to suppressed addresses;
- keep the permanent bounce rate below 2% and the spam complaint rate below 0.1%: above that, the account reputation stops growing and may drop (section 7);
- periodically remove contacts who haven't engaged in a long time;
- comply with applicable law, including the General Data Protection Law (LGPD) and the Consumer Protection Code.
4. Forms
Postal forms live on public pages (forms.postal.so) or on your site. You are responsible for the content, the questions, and the consent text of your forms, and for informing people how their data will be used. Do not use forms to collect passwords, card data, or sensitive personal data. On free plans, forms and emails may display the "Sent with Postal" badge.
5. AI assistant
The AI assistant's suggestions are generated automatically and may contain errors. Review the content before sending: you remain responsible for everything you send. Do not enter sensitive personal data into the assistant unless it is necessary.
6. Plans, payments, and cancellation
- Paid plans are billed on a recurring basis, in reais, dollars, or euros, depending on the currency chosen at signup, through our payment processor.
- When you allow sending beyond the plan quota, the overage is billed per thousand emails, in the following cycle.
- You can change plans or cancel in the dashboard. Cancellation takes effect at the end of the period already paid, and there is no prorated refund, except where the law requires it.
- If a payment fails, we may limit sending until it is resolved. Prices and limits may change, with prior notice.
7. Account reputation and sending limits
Postal cares about the quality of every send: it is what gets our customers' email to the inbox. That is why we are strict about spam and abuse: it is how we protect the deliverability of customers who send properly.
- Account reputation: each account has a reputation, calculated from its sending history. New accounts start with zero reputation and with lower daily sending limits, which grow as the account builds up days of sending without problems. The mere passing of time, without sending, does not raise the reputation.
- Reputation drops: the reputation may drop, and the sending limits may decrease, when bounces, spam complaints or content rejected by email providers go above acceptable levels, or when sending is paused.
- Limits: in addition to the limits of the subscribed plan (daily, monthly and requests per second on the API), the account reputation limits apply, and the lower one always prevails. The criteria and the values in force are in the documentation and may be adjusted to protect the platform.
- Automatic pause: Postal may pause sending automatically when bounce, complaint or rejected-content rates go over the limits, until the situation is reviewed.
Sending email without the recipient's consent is forbidden. In case of spam, sending to purchased, rented or scraped lists, phishing, scams or misleading content, Postal may pause sending and suspend or close the account immediately, without prior notice. When the suspension or closure results from a breach of these Terms, there is no refund for the period already paid, except where the law requires it.
We may also reduce limits, pause sending or suspend the account in case of high bounce or complaint rates, risk to the platform's reputation or a request from a competent authority. Whenever possible, we will tell you the reason and how to fix the situation, and anyone whose sending is paused can request a review in the dashboard or through the contact form.
8. Your data and the content of emails
You remain the owner of the content you send and are the controller of the personal data of your contacts and recipients, including data collected through forms. Postal processes this data only to provide the service, as a processor, in accordance with the Privacy Policy.
9. Availability and liability
We work to keep the service stable, but email delivery depends on third parties, such as recipients' providers, and cannot be guaranteed. The service is offered "as is" during the beta. To the extent permitted by law, Postal is not liable for lost profits or indirect damages arising from use or unavailability of the service.
10. Termination
You can close your account at any time in the dashboard or through the contact form. We may also close inactive accounts or accounts that breach these Terms, as set out in section 7.
11. Changes
We may update these Terms. Material changes will be communicated by email to the account or through the dashboard before they take effect.
12. Governing law and contact
These Terms are governed by the laws of the Federative Republic of Brazil. Questions, abuse reports or requests can be sent through the contact form.
